General Terms of Service

The following General Terms of Service apply in relation to a Customer of Target Food OÜ (acting with trade name “MealPrep”) and MealPrep on the MealPrep Platform. These General Terms of Service for Food Delivery on MealPrep Platform (hereinafter referred to as “Terms”) constitute a legally binding agreement between the Customer and MealPrep (hereinafter referred to as “Sales Agreement”), defining the rights and responsibilities of both parties regarding Food Order and Food Delivery. By placing an order for Food Delivery, the Customer acknowledges having read and agreed to comply with these Terms. These Terms apply to all Food Order made through the MealPrep Platform.

1. DEFINITIONS

2. Description of services

2.1 MealPrep is a food delivery service operated by TargetFood OÜ (Registration Code: 16425078, Adress: Tartu maakond, Tartu linn, Tartu linn, Ihaste põik 22-2, 51011).

2.2 The MealPrep Platform provides a customers the ability to enter into a Sales Agreement between the Customer and TargetFood OÜ, where TargetFood OÜ provides Food Delivery services to the Customer according to Food Order.

2.3 A Customer may select various Food Order packages constitution of varying meals on the MealPrep Platform that TargetFood OÜ prepares and delivers to the Customer according to the Customer choices on the platform and within selected Delivery Time.

3. CUSTOMER RIGHTS AND OBLIGATIONS

3.1 Customer have the right to place Food Order through the MealPrep Platform and receive Food Delivery services according to Customer Preferences and Delivery Address.

3.2 Customer must provide accurate and up-to-date information, including the Delivery Address, contact details, and dietary preferences.

3.3 Customer are responsible for ensuring that someone is present at the Delivery Address to receive the Food Delivery during the specified Delivery Time.

3.4 The Customer may only place Food Order for themselves or on behalf of other individuals with proper prior authorization.

3.5 A Customer has the right to halt their food order package plan for a total of 6 months if they notify TargetFood OÜ of their wish to do so via electronic means at least 24 hours prior schedule Delivery Time. 

4. TARGET FOOD OÜ RIGHTS AND OBLIGATIONS

4.1 Target Food OÜ has the right to refuse or cancel any Food Order if there are reasonable grounds to believe that the order violates these terms or any applicable local laws.

4.2 Target Food OÜ is responsible for preparing and delivering Food Order in a timely manner and in accordance with the Customer Preferences.

4.3 Target Food OÜ reserves the right to make changes to the MealPrep Platform, Food Package offerings, and prices with prior notice to Customer.

4.4 TargetFood OÜ strives to provide accurate nutritional information; however, the company does not guarantee the accuracy of such information. TargetFood OÜ shall not be held liable for any damages or losses arising from inaccurate nutritional information or the unsuitability of food products in relation to the Customer’s dietary needs, restrictions, or preferences.

4.5 While TargetFood OÜ strives to provide a seamless service, the company shall not be held liable for circumstances beyond its control, including but not limited to:

1. a) An incorrect delivery address provided by the Customer
2. b) An incorrect phone number provided by the Customer
3. d) Failure to accept the ordered food by the Customer due to reasons not attributable to TargetFood OÜ
4. e) Failure of Customer to pay for the Food Order without valid reasons

    

5. ORDERING SERVICES

5.1 Customer can place Food Order through the MealPrep Platform, selecting their desired Food Package, calorie options, dietary needs and Delivery Time

5.2 Once an order is placed via MealPrep Platform, Customer will receive an order confirmation and details of the scheduled Food Delivery together with purchase receipt to his provided e-mail address.

6. PRICES

6.1 The prices for Food Packages are displayed on the MealPrep Platform and are subject to change. CUSTOMER will be charged based on the prices at the time of placing the Food Order.

6.2 All prices are inclusive of applicable taxes (VAT) and fees.

7. DELIVERY

7.1 Delivery Times will be specified on the MealPrep Platform and confirmed with the Customer upon placing the order.

7.2 While Target Food OÜ will make reasonable efforts to adhere to the specified delivery times, unforeseen and force major circumstances might cause delays in such deliveries.

7.3 In the case that a Customer has paid for a Food Order and wishes to change the selected Delivery Time the Customer must do so prior to 12:00 pm the day prior to the scheduled delivery, a failure to do so shall result in the Customer not being guaranteed their order without any right to a refund for their food order from TargetFood OÜ.

8. PAYMENT

8.1 Customer can make payments for Food Order through the payment methods provided on the MealPrep Platform such as bank link, debit cards or cash upon delivery.

8.2 Payments are processed securely, and payment information is encrypted to ensure Customer data protection.

9. CAMPAINGS AND DISCOUNT CODES

9.1 Campaings may include but are not limited to, discount codes, special offers, referral bonuses, and loyalty rewards. The terms and details of each Promotion will be clearly communicated to Customer through various channels, including the MealPrep Platform, emails, and other marketing materials.

9.2 Any discount code is strictly personal and must not be used for uncontrolled distribution without prior approval from Target Food OÜ.

9.3 Target Food OÜ reserves the right to invalidate or revoke promotional codes if fraudulent or abusive behavior is detected.

9.4 If Target Food OÜ suspects any Customer of abusing Promotions or violating the terms outlined in this article, Target Food OÜ reserves the right to take appropriate actions, including suspending or terminating the Customer access to Promotions or the MealPrep Platform.

10. PROCESSION PERSONAL DATA

10.1 MealPrep collects and processes personal data of Customer for the purpose of providing the Food Delivery service, in accordance with its Privacy Policy.

10.2 Customer have the right to access, correct, and request deletion of their personal data. 

11. CANCELLATION AND REFUNDS

11.1 Customer may cancel Food Order within a specified timeframe at least 24 hr prior planned Delivery Time. In such case TargetFood OÜ shall refund the Customer with the sum pre-paid by the Customer for the undelivered part of the package plan.

11.2 Target Food OÜ reserves the right to charge a cancellation fee for already incurred services if cancellations are made outside the specified timeframe.

12. INTELLECTUAL PROPERTY

12.1 The content and design of the MealPrep Platform are protected by intellectual property laws. Customer are prohibited from using, reproducing, or distributing the platform’s content without authorization.

13. GOVERNING LAW

13.1 These General Terms of Service are governed by and construed in accordance with the laws of Estonia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the Estonian courts.

14. AMENDMENTS

14.1 Target Food OÜ reserves the right to update or modify these General Terms of Service. Customer will be notified of any changes, and continued use of the MealPrep Platform constitutes acceptance of the revised terms.
